1. Agreement to Terms
By booking or staying at Appartamento del Palio ("Property," "we," "us," or "our"), you ("Guest," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not book or use our services.
Our property is located at 35 Via Angelo Brofferio, 14100 Asti, Italy, and is operated by Silvia and Ana as vacation rental hosts.
2. Booking and Reservations
2.1 Booking Process
- Bookings can be made through our website, Airbnb, Booking.com, or direct contact
- All bookings are subject to availability and confirmation
- You must be at least 18 years old to make a booking
- Accurate information must be provided for all guests
2.2 Payment Terms
- Payment is required according to the platform's or our direct booking terms
- For direct bookings: 50% deposit required to secure reservation, balance due 7 days before arrival
- All prices include applicable taxes unless otherwise stated
- Additional fees may apply for extra services or damages
2.3 Confirmation
Your booking is confirmed when you receive written confirmation from us via email. Check-in instructions will be provided 24-48 hours before your arrival.
3. Cancellation Policy
3.1 Guest Cancellations
- More than 30 days before check-in: Full refund minus processing fees
- 15-30 days before check-in: 50% refund
- Less than 15 days before check-in: No refund
- Early departure: No refund for unused nights
Note: Bookings made through third-party platforms (Airbnb, Booking.com) are subject to their respective cancellation policies.
3.2 Host Cancellations
In the unlikely event we must cancel your booking, we will provide full refund and assist in finding alternative accommodation when possible. We are not liable for additional costs incurred due to our cancellation.
4. Check-in and Check-out
4.1 Check-in
- Time: 3:00 PM - 10:00 PM
- Process: Self check-in with detailed instructions provided
- Late arrival: Must be arranged in advance; additional fees may apply
- ID Required: Valid government-issued photo ID for all guests
4.2 Check-out
- Time: 10:00 AM - 10:30 AM
- Process: Leave keys as instructed, lock the apartment
- Late checkout: Subject to availability; additional fees may apply
5. Guest Responsibilities and Rules
5.1 Occupancy
- Maximum occupancy: 4 guests
- Only registered guests are permitted to stay overnight
- Day visitors must be approved in advance
- No subletting or assignment of the reservation
5.2 Property Rules
- No Smoking: Smoking is strictly prohibited inside the apartment
- No Pets: Pets are not allowed
- No Parties: Events, parties, or gatherings are not permitted
- Quiet Hours: 9:00 PM - 8:00 AM (respect for neighbors)
- No Illegal Activities: Any illegal activities are strictly prohibited
5.3 Care of Property
- Treat the property with respect and care
- Report any damages or issues immediately
- Use appliances and facilities responsibly
- Keep the apartment reasonably clean during your stay
- Do not rearrange furniture or remove items from the property
6. Damages and Additional Charges
6.1 Security Deposit
A security deposit may be required and will be returned within 7 days after checkout, less any deductions for damages, excessive cleaning, or rule violations.
6.2 Damage Policy
- Guests are responsible for any damage caused during their stay
- Normal wear and tear is expected and not charged
- Repair or replacement costs will be charged at fair market value
- Smoking violations incur a minimum €200 cleaning fee
6.3 Additional Services
- Extra cleaning (if required): €30-50
- Lost key replacement: €50
- Late checkout (when available): €25
- Luggage storage (when available): €10 per day
7. Liability and Insurance
7.1 Limitation of Liability
We provide the accommodation "as is" and are not liable for any personal injury, property damage, or loss unless directly caused by our negligence. Our liability is limited to the amount paid for your reservation.
7.2 Guest Insurance
We strongly recommend guests obtain travel insurance. We are not responsible for medical expenses, trip cancellations, or personal belongings. Guests stay at their own risk.
7.3 Force Majeure
We are not liable for any failure to perform our obligations due to circumstances beyond our control, including but not limited to natural disasters, government actions, or public health emergencies.
8. Privacy and Data Protection
Your personal information is handled in accordance with our Privacy Policy and applicable data protection laws, including GDPR. We collect and process guest information for booking management, legal compliance, and safety purposes.
Guest registration with local authorities is required by Italian law for all visitors. This property operates under Italian tourism license IT005005C2VRVVGAUN.
9. Dispute Resolution
9.1 Communication First
We encourage guests to contact us directly with any concerns during or after their stay. Most issues can be resolved through open communication.
9.2 Mediation
If a dispute cannot be resolved directly, both parties agree to attempt mediation before pursuing legal action.
9.3 Governing Law
These terms are governed by Italian law. Any legal disputes will be subject to the jurisdiction of the courts in Asti, Italy.
10. Modifications and Updates
We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the revision date. Your continued use of our services constitutes acceptance of any changes.
11. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
